Our Terms & Conditions

Overview

The terms ‘One Turtle Studio’ or ‘our’ ‘us’ ‘we’ ‘my’ ‘I’ refers to the owner of this website. The term ‘you’ ‘your’ or ‘users’ refers to the users or viewer of our website.

All services provided by this website may only be used in accordance with the terms and conditions provided below. By using our services you agree to be bound by our terms and conditions.

One Turtle Studio reserves the right to make modifications and changes to these terms and conditions at any time and without prior notice. Up to date terms and conditions will always be available at www.oneturtlestudio.com.

The placing of an order with One Turtle Studio creates a contract on the basis of these terms and conditions. These terms and conditions apply equally to all orders given, irrespective of method. It is the responsibility of the user of our services to be aware of our terms and conditions.

Nothing in this agreement will affect any consumer’s statutory rights.

We reserve the right to send special offers and newsletters to account holders email addresses, with an instant unsubscribe option available.

Placing an order

By placing an order for Prints through our site, you represent that: (i) you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site; (ii) you are legally capable of entering into binding contracts; (iii) you will not copy, distribute or share the Prints other than as allowed under these Terms; and (iv) you will not use our products for any illegal or unauthorized purpose or, in the use of these Services, violate any laws in your jurisdiction (including but not limited to copyright laws).

The placing of an order online, via email, in person or by phone constitutes acceptance of prices shown on our website and you will be held liable for the full order value.

As all our prints are made to order, in the event that you wish to cancel or amend an order please contact us as soon as possible and within 24 hours. If work has commenced on your order we will not offer any monetary compensation and you will be held liable for payment in full.

All orders are finished by hand and because of this One Turtle Studio shall accept no liability for minor variations in dimensions.

Prices and Payment

All rates, prices and discounts quoted or published at oneturtlestudio.com are subject to variation at any time prior to acceptance your order. VAT is not currently charged on transactions for goods or services.

Payment is required in full at the time of placing your order.

Delivery

Charges for postage, packing and delivery will be incurred and payable at the time of order and are as follows:

Shipping Costs
Free delivery on all UK orders.
Free delivery on all International orders worth £100 or more.

Shipping costs on orders less than £100:
UK – Free
Europe – £5
USA – £8
Rest of World – £10

You shall be responsible for all customs and other duties and all related costs and expenses payable on any international transaction.

Where specified you will be required to sign for delivered work, or we will not be held responsible for any losses arising from the delivery.

Goods shall be delivered to the delivery address specified, if representatives are unable to gain access to the delivery address or delivery is delayed due to any act or omission of the customer, you will be held liable for any additional delivery costs incurred as a result of re arranging delivery.

Immediately upon receipt of any goods, you should inspect and satisfy yourself with its condition. If you fail to inform us within 48 hours after receipt or collection, of any defect or problem you shall be deemed to have confirmed that the goods are in a satisfactory condition upon delivery or collection and payment will remain due in full.

One Turtle Studio will offer a replacement if an item is deemed ‘lost in the post’. In this instance this will only apply if an exact address has been supplied and no evidence exists to suggest the customer has been left a delivery card or contacted by a courier service in relation to the delivery. Such a replacement will only be offered when the appropriate delivery time as stated on our website has expired.

One Turtle Studios maximum liability shall not exceed the total sum payable in connection with the relevant order. We shall not be liable for any loss of income or profits, loss of contracts or for any indirect or consequential loss or damage of any kind howsoever arising.

Supplier Delivery terms – Luxe Eco Prints – dStudio
Orders within the UK will be delivered using the Royal Mail First Class postal service. Delivery time is 1-2 working days (including Saturday).

International orders will be delivered using the Royal Mail Airmail Standard postal service. Delivery time is 3 to 5 working days.

Supplier Delivery terms – Greeting Cards – Prodigi
Prodigi facilitates global printing at a local level and as such delivery times may vary. According to the International Transport Forum, international trade-related freight transport is responsible for 7% of all carbon emissions globally. By operating an international network of print labs connected through software the company helps online businesses produce products closer to the end consumer to significantly reduce carbon emissions.

Digital Prints
After you place an order you will receive the high resolution file immediately and also in your email. Sometimes the email may take a few minutes, and also it’s good to check your spam folder in case it ends up there by mistake.

Once you have this file we recommend you save it somewhere (your desktop, an external drive, etc.). Then you can print the file anywhere you choose at whatever size you need. You can also alter the file by cropping or tweaking the colouring if you prefer.

All our files are 25MB or less so that most print shops (online or otherwise) will be able to take them.

You can print your purchased file as many times as you like. Although we ask that you do not resell our designs. We also kindly ask that you do not share the file itself.

Returns and Damages

We want you to be 100% satisfied with your purchase.

If for any reason you are not satisfied with your purchases please email us at hello@oneturtlestudio.com within 48 hours upon receipt.

In the event that your print is damaged in any way upon receipt, please contact us as soon as possible. We cannot be held responsible for any damage to, discrepancies in or shortages of delivered materials unless notified within 48 hours of receipt. If we are not contacted by you within 48 hours of receipt you shall be deemed to have confirmed that the goods are in a satisfactory condition upon delivery and payment will remain due in full.

Any claims for damages must be supported by photographic evidence and we reserve the right and may request the return of the damaged article, for which we will cover the cost. Claims of this nature will be limited to the cost of the order as charged by One Turtle Studio. No actions will be taken by One Turtle Studio without photographic proof of the receipt of the damaged item.

If you are eligible for a refund, we will reimburse the price you have paid for the goods by means of your original payment method.

If a reprint is offered it will be resent to you free of charge.

It is not our policy to offer both a refund and a reprint.

Digital Downloads
At the point of purchase all sales are final. Given the nature of digital downloads there is no way to return the file once it has been emailed to you. For this reason we do not accept returns. If you have questions about a design we highly recommend contacting us before you purchase. If the error is on our part, e.g. we sent you an incorrect file, please do let us know and we will course make that right.

Colour Matching

With the multitude of electronic devices for viewing your product and the imprecise nature of colour management you may find that the colours of your print do not match those of your particular screen. If you are not 100% satisfied with your print please see our Returns policy.

Specified Lead Times

We will make every effort to ensure orders are completed within any lead times, where stated, but cannot accept liability of consequential losses arising should these not be met. Lead times which are quoted are target times only and start only from the point at which we receive all order details required to complete your order.

Payment for your order will still be due in full and no monetary compensation will be offered should we fail to meet a quoted delivery time. One Turtle Studio reserves the right to amend our lead times without prior notice.

Copyright / Licencing

Prints available through the site are owned or controlled by us and are protected by intellectual property rights.

Any use of prints purchased through the site is subject to these Terms and Conditions of Sale.

Some of our images which are generally found on Social Media are available under a Creative Commons – Non-Commercial licence.

Creative Commons Licence
With Creative Commons you are free:
To Share: Copy, Distribute, and Transmit the image.
To Remix: Create Derivative works of the image.

Non-Commercial: The image must not be used for commercial purposes under any circumstances. For clarity on what defines commercial use, please see the Example Uses below.

Examples of accepted use of the Creative Commons Licence:

Personal Blog Post on eco photography or creativity.
Online article discussing the important of mindset to creativity and change.
Using an image as a desktop background on a personal computer monitor in a private location.

Commercial Licencing
‘Commercial Use’ regarding the use of images online or offline is defined very broadly. The determination of commercial or non-commercial use is based on the contextual use of the image. The determination is NOT based on the tax-filing status of the entity using the image nor on whether or not a financial transaction takes place.

Commercial use of our images is allowed only if expressly granted by Blanaid Mason. All commercial uses will incur a licencing fee. Fees are based on the following variable criteria:

Type of Media – Web, print, etc.
Geographical Distribution
Length of Use – Single use, 1 year, 2 years, etc.
Prominence of Use – Full page, 1/2 page, home page (online), etc.

Examples of uses requiring a licence to copyright:

A marketing campaign for a commercial entity
A fund-raising campaign for a not-for profit entity
A background image for a website
Licence to create an individual print for use in a private home
Internal business use. i.e. As part of a presentation.

Digital Prints
Upon payment of the price for any Digital Print, we grant you a non-exclusive, non-transferable license to use the Digital Print consistent with these terms.

You agree that you will use Digital Prints for a private, non-commercial use only and that you will not copy, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, sublicense or transfer any Digital Prints to anyone else. Nothing in these Terms grants to you any rights other than those expressly set out herein. These Terms do not grant to you any rights in relation to the synchronization, public display, promotional use, commercial sale, resale, reproduction, distribution or commercial exploitation of any Print.

We will be entitled to obtain injunctive relief against you, in addition to all other remedies that we may have, to enforce these Terms and to prevent your unauthorized use of this site and/or our Prints.

Digital Prints are capable of being downloaded to and stored on the hard drive of your computer and then exported, burned or copied. You must adhere to any and all usage restrictions that apply to the Digital Prints as set out in these Terms.
